{"id":2138,"date":"2019-09-26T12:16:00","date_gmt":"2019-09-26T10:16:00","guid":{"rendered":""},"modified":"2023-03-15T11:53:18","modified_gmt":"2023-03-15T09:53:18","slug":"uob-acusa-educacio-de-coaccionar-els","status":"publish","type":"post","link":"https:\/\/uob.cat\/ensenyament\/2019\/09\/26\/uob-acusa-educacio-de-coaccionar-els\/","title":{"rendered":"UOB acusa Educaci\u00f3 de coaccionar els docents perqu\u00e8 fitxin"},"content":{"rendered":"<p>Circular 152\/2019- 1<\/p>\n<p>COMUNICAT DE PREMSA<\/p>\n<p>Uni\u00f3 Obrera Balear, sectorial d&#8217;Ensenyament, acusa la Conselleria d&#8217;Educaci\u00f3 de coaccionar els docents a trav\u00e9s d&#8217;Inspecci\u00f3 perqu\u00e8 fitxin a les entrades i sortides i d&#8217;imposar la mesura sense cap base legal, i  es referma en la crida a la insubmissi\u00f3. <\/p>\n<p>Tot i que el 12 de juliol vam demanar oficialment en quina normativa es basa Educaci\u00f3 per obligar els docents a fitxar, continuam sense resposta escrita. El director general de Planificaci\u00f3, Antoni Morante, va afirmar en mesa sectorial el 17 de setembre que la base legal \u00e9s la resoluci\u00f3 signada pel conseller March, les<br \/>\ninstruccions d&#8217;inici de curs i l&#8217;Estatut B\u00e0sic de l&#8217;Empleat P\u00fablic. Per\u00f2 la resoluci\u00f3 del conseller no s&#8217;ha publicat al BOIB ni d\u00f3na opci\u00f3 a ser recorreguda, les instruccions s\u00f3n un document sense signar penjat a la web, i l&#8217;EBEP no diu res sobre el marcatge horari. En canvi, la normativa estatal de Funci\u00f3 P\u00fablica sobre jornada i horaris (<a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2019-2861#A1-8\">Resoluci\u00f3 de 28 de febrer de 2019<\/a>) que<br \/>\nestableix el registre horari, n&#8217;exclou el<br \/>\npersonal docent per la seva \u00abnaturalesa singular\u00bb, aix\u00ed com els militars, policies, funcionaris de presons i sanitat.<\/p>\n<p>Davant aquest buit legal, denunciam que el servei d&#8217;Inspecci\u00f3 coacciona els docents a trav\u00e9s dels directors, que transmeten als claustres que \u00abs&#8217;ha de fitxar perqu\u00e8 ho diuen les instruccions\u00bb, i al mateix temps afirmen que nom\u00e9s \u00e9s una eina per als directors i no hi ha conseq\u00fc\u00e8ncies autom\u00e0tiques si no es fitxa, que a la Conselleria no saben com resoldre els casos en qu\u00e8 no es fitxi, i que la mesura est\u00e0 \u00aben per\u00edode de proves\u00bb. Si a tot aix\u00f2 hi afegim els innumerables problemes que fan el sistema tan inviable com injust, i que Planificaci\u00f3 ha anunciat una nova mesa sectorial sobre el tema el mes d&#8217;octubre, \u00e9s evident que els srs. March i Morante s&#8217;han ficat dins un fangar i no saben com sortir-se&#8217;n.<\/p>\n<p>UOB insisteix en qu\u00e8 es retiri la instrucci\u00f3 i es recuperi la normalitat pel que fa al control horari. Si Educaci\u00f3 persisteix en l&#8217;obcecaci\u00f3, i s&#8217;atreveix a expedientar o tocar la n\u00f2mina a un sol docent pel simple fet de no pitjar la tecla d&#8217;un ordinador, quan ha complit rigorosament amb el seu horari oficial a m\u00e9s de fer totes les hores extra que no ens s\u00f3n reconegudes, li auguram al sr. March una resposta sindical contundent en defensa dels nostres drets.<\/p>\n<p>Mantenim amb m\u00e9s motiu que mai la crida a la insubmissi\u00f3 i a convocar claustres per manifestar l&#8217;oposici\u00f3 al marcatge horari.
